TERMS OF SERVICE
1. General
These Terms of Service govern the use of the NOBRAKES online store and all purchases made through it.
The seller is Dmitriy Hamerskyy, operating under the NOBRAKES name.

By placing an order, you confirm that you have read and accepted these Terms of Service.
2. Products
We make reasonable efforts to display product descriptions, colours, measurements and photographs as accurately as possible. Minor differences may occur due to screen settings, manufacturing processes or the nature of materials.
Customers are responsible for reviewing product descriptions and size information before ordering.
All products are subject to availability.
3. Orders
An order is submitted when you complete checkout and payment is successfully authorised.
After placing an order, you will receive an order confirmation by email.
We reserve the right to cancel an order where reasonably necessary, including in cases of payment failure, suspected fraud, obvious pricing errors, product unavailability or circumstances preventing lawful fulfilment.
If we cancel an order that has already been paid, the applicable amount will be refunded to the original payment method.
4. Prices and payment
Prices are displayed in the currency applicable to the customer's market where supported.
Any taxes collected directly by us will be shown during checkout where applicable.
Payment may be made using the payment methods available at checkout.
Customers ordering from outside the European Union may be responsible for import VAT, customs duties, brokerage fees or other charges imposed by the destination country unless expressly stated otherwise during checkout.
5. Pre-orders
Some NOBRAKES products may be offered on a pre-order basis.
A pre-order means that the product is purchased and paid for before it is ready for shipment. The estimated dispatch period will be displayed on the product page, cart, checkout or another relevant part of the store.
Estimated production and dispatch dates are provided in good faith but may change due to manufacturing, logistics or circumstances outside our reasonable control. If a material delay occurs, we will provide updated information where reasonably possible.
Customers may submit a cancellation request before a pre-order has been fulfilled. Any statutory consumer rights remain unaffected.
Pre-order products are not excluded from statutory withdrawal or return rights merely because they were sold as pre-orders, unless a specific legal exception applies.
6. Shipping and delivery
Available shipping methods, prices and estimated transit times are displayed during checkout.
Delivery times shown at checkout refer to the estimated transportation time after dispatch. For pre-orders, the production and pre-order waiting period is separate from the carrier's delivery time.
Customers are responsible for providing a complete and accurate delivery address.
International orders may be subject to customs processing and additional delays.
7. Returns and right of withdrawal
Eligible consumers may withdraw from an online purchase within the period required by applicable consumer law.
For consumers in the European Union, the withdrawal period is generally 14 days from receipt of the goods.
Our detailed return conditions are described in our Return & Refund Policy, which forms part of these Terms.
For standard change-of-mind returns, the customer is responsible for the direct cost of return shipping where permitted by applicable law and where the customer was informed of this before purchase.
8. Faulty, damaged or incorrect products
Nothing in these Terms limits statutory consumer rights relating to defective or non-conforming goods.

Where required by law, remedies for defective or non-conforming goods will be provided without additional cost to the consumer.
9. Cancellations
Where available, customers may submit an order cancellation request before fulfilment.
Submitting a cancellation request does not mean that the order has been cancelled until the cancellation is confirmed.
Any mandatory cancellation or withdrawal rights provided by applicable consumer law remain unaffected.
10. Intellectual property
All original NOBRAKES branding, graphics, photographs, text, layouts and other original website materials are protected by applicable intellectual property laws.
You may not reproduce, distribute or commercially exploit our original content without prior written permission.
11. Prohibited use
You may not use the website for unlawful, fraudulent or abusive purposes, interfere with its operation, attempt unauthorised access to systems or use automated methods intended to disrupt the store, manipulate inventory or interfere with checkout.
12. Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
To the extent permitted by applicable law, we are not responsible for indirect losses that were not reasonably foreseeable when the contract was entered into.
Mandatory consumer rights always take precedence over any conflicting provision in these Terms.
13. Personal data
Personal information is processed in accordance with our Privacy Policy and applicable data protection laws.
14. Changes to these Terms
We may update these Terms from time to time.
Changes apply prospectively and do not remove rights already acquired by customers under orders placed before an update.
15. Governing law
These Terms are governed by the laws of Poland.
For consumers, this choice of law does not deprive you of mandatory consumer protections applicable under the law of your country of habitual residence.
